Content & Takedown Policy
Last updated: March 2026
1. Overview
ProofBooked is a software-as-a-service platform for home service contractors. Contractors use the platform to publish proof pages containing photos, voice-memo transcripts, and AI-generated descriptions of completed work. These proof pages may be shared with homeowners and, at the contractor's option, made publicly accessible.
ProofBooked respects the intellectual property rights of others and expects its users to do the same. We respond promptly to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §§ 512 et seq.
2. DMCA Designated Agent
ProofBooked has registered a designated copyright agent with the U.S. Copyright Office. Notices of claimed infringement must be directed to:
Agent status: Active — Effective March 19, 2026
3. Filing a DMCA Takedown Notice
If you believe that content on ProofBooked infringes a copyright you own or control, you may submit a written takedown notice to our designated agent at copyright@proofbooked.com. To be valid under 17 U.S.C. § 512(c)(3), your notice must include all of the following:
- Identification of the copyrighted work. A description of the copyrighted work you claim has been infringed, or, if multiple works are covered by a single notice, a representative list of such works.
- Identification of the infringing material. A description of the material you claim is infringing and information reasonably sufficient to permit us to locate it, including the full URL of the proof page where the material appears (e.g., https://proofbooked.com/p/[slug]).
- Contact information. Your name, mailing address, telephone number, and email address.
- Good faith statement. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or applicable law.
- Accuracy statement under penalty of perjury. A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on the copyright owner's behalf.
- Physical or electronic signature. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner.
We will review properly submitted notices and, where appropriate, remove or disable access to the allegedly infringing content. Submitting a false DMCA notice may expose you to liability under 17 U.S.C. § 512(f).
4. Counter-Notice Process
If you believe content was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification with our designated agent at copyright@proofbooked.com. A valid counter-notification under 17 U.S.C. § 512(g)(3) must include:
- Your physical or electronic signature.
- Identification of the content that was removed or disabled, and the URL where the content appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification.
- Your name, mailing address, telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which ProofBooked may be found), and that you will accept service of process from the person who provided the original takedown notice.
Upon receipt of a valid counter-notification, we will forward a copy to the original complainant and notify them that we may restore the content. We will restore the removed content within 10 to 14 business days of receiving the counter-notification, unless the original complainant informs us that they have filed a court action seeking to restrain the activity.
5. Repeat Infringer Policy
ProofBooked maintains a three-strike policy for copyright infringement:
- First notice: The specific infringing content is removed and the account holder is notified.
- Second notice: The infringing content is removed, the account holder is warned, and publishing privileges may be temporarily suspended.
- Third notice: The account is permanently terminated and all associated content is removed.
ProofBooked reserves the right to terminate accounts of users who are determined, at our sole discretion, to be repeat infringers, regardless of the number of prior notices received.
5.5. Non-Consensual Intimate Imagery (Take It Down Act)
ProofBooked prohibits the upload or distribution of non-consensual intimate imagery (NCII), including AI-generated intimate images created without the depicted individual's consent.
If you believe that non-consensual intimate imagery of you appears on ProofBooked, you or an authorized person acting on your behalf may report it using the report form on any proof page (select “Non-consensual intimate imagery” as the category), or by emailing copyright@proofbooked.com with the subject line “NCII Removal Request.”
Upon receiving a valid request, ProofBooked will:
- Remove or disable access to the reported content within 48 hours
- Notify the account holder that content was removed for a policy violation (without disclosing the reporter's identity)
- Take appropriate action against the account, up to and including permanent termination
Knowingly submitting a false NCII report may result in account suspension.
7. Reporting Non-Copyright Content Issues
For content that does not involve a copyright claim — including personally identifiable information (PII) that should not appear on a public page, spam, misleading content, or otherwise inappropriate material — please use the report form located in the footer of any proof page. The report form allows you to describe the specific concern and submit it directly to our review team.
We review all submitted reports and will take appropriate action, which may include removing specific content, contacting the account holder, or disabling the proof page pending review.
